Terms of Service

“VTel Wireless” or “VTel”, or “we,” “us,” or “our” refers to VTel Wireless, Inc. “You” or “your” refers to the person or entity that is the customer of record.

Thank you for choosing VTel Wireless. This Agreement applies to our wireless products, features, applications, and services (“Services”) and contains important information about the Services you have ordered, including your rights, responsibilities, limitations on the Services and your use of those Services. VTel Service(s) may be used with a wireless device assigned to your account (“Device”) and/or a device that is designed and purchased for use on VTel’s network (“Equipment”).

This Agreement, including the VTel Wireless Privacy Policy, your specific order for Services (“Order”),our Acceptable Use policy, and any additional terms of service for wireless products, features, applications, and services that we provide to you and/or are posted on applicable VTel websites or devices (“Service Policies”), and any documents expressly referred to herein or therein, make up the complete agreement between you and VTel and supersede any and all prior agreements and understandings relating to the subject matter of this Agreement.

IMPORTANT: READ THIS ON-LINE SERVICES AGREEMENT BEFORE USING ANY OF THE SERVICES AVAILABLE THROUGH VTEL WIRELESS. You accept this agreement by: (i) agreeing in writing, by email, over the phone, or in person; (ii) clicking on “I Accept” in an on-line click-through format; (iii) opening a package that says you are accepting by opening it; or (iv) activating your Service. When you accept, you are representing that you are at least 18 years old and are legally able to accept an agreement. If you are accepting for an organization, you are representing that you are authorized to bind that organization, and where the context requires, “you” means the organization. By accepting you are agreeing to every provision of this Agreement whether or not you have to read it. YOUR ACCEPTANCE OF THIS AGREEMENT WILL CONSTITUTE YOUR ACCEPTANCE OF ALL THE FOLLOWING TERMS, AND THOSE CONTAINED IN OUR WIRELESS INTERNET AGREEMENT.

  1. LIMITED WARRANTY. The accuracy, completeness, timeliness or correct sequencing of the information obtained from our service is not guaranteed by VTel Wireless or any parties transmitting the information (“Information Transmitters”). There may be delays, omissions or inaccuracies in the information. You agree that neither VTel Wireless, the Information Providers nor the Information Transmitters shall have any liability contingent or otherwise, for the accuracy, completeness or correct sequencing of the information, or for any decision made or action taken by you in reliance upon the information of the service, or for the interruption of any data, information or aspect of the service. There is no warranty of merchantability, no warranty of fitness for a particular use, and no warranty of non-infringement. There is no other warranty of any kind, express or implied, regarding the information or any aspect of the service (including but no limited to information access and order execution).
  2. LIMITATIONS OF LIABILITY. UNLESS PROHIBITED BY LAW, THE FOLLOWING LIMITATIONS OF LIABILITY AND DISCLAIMERS APPLY. SOME STATES DO NOT ALLOW DISCLAIMERS OF IMPLIED WARRANTIES OR LIMITS ON REMEDIES FOR BREACH. THEREFORE, THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. THIS AGREEMENT GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY HAVE OTHER RIGHTS WHICH VARY FROM STATE TO STATE. VTEL WIRELESS MAKES NO WARRANTY, EXPRESS OR IMPLIED, OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, SUITABILITY, ACCURACY, SECURITY, OR PERFORMANCE REGARDING ANY SERVICES, SOFTWARE OR GOODS (INCLUDING BUT NOT LIMITED TO ANY DEVICE OR EQUIPMENT). WE DO NOT WARRANT THAT YOUR DEVICE AND/OR EQUIPMENT WILL WORK PERFECTLY OR WILL NOT NEED UPGRADES OR MODIFICATIONS, OR THAT IT WILL NOT BE AFFECTED BY NETWORK–RELATED MODIFICATIONS, UPGRADES OR SIMILAR ACTIVITY.IN NO EVENT SHALL VTEL WIRELESS BE LIABLE, WHETHER OR NOT DUE TO ITS OWN NEGLIGENCE, FOR ANY: (A) ACT OR OMISSION OF A THIRD PARTY; (B) MISTAKES, OMISSIONS, INTERRUPTIONS, ERRORS, FAILURES TO TRANSMIT, DELAYS, OR DEFECTS IN THE SERVICES OR SOFTWARE PROVIDED BY OR THROUGH US; (C) DAMAGE OR INJURY CAUSED BY THE USE OF SERVICES, SOFTWARE, DEVICE OR EQUIPMENT, INCLUDING USE IN A VEHICLE; (D) CLAIMS AGAINST YOU BY THIRD PARTIES; (E) DAMAGE OR INJURY CAUSED BY A SUSPENSION OR TERMINATION OF SERVICES OR SOFTWARE BY VTel; OR (F) DAMAGE OR INJURY CAUSED BY INABILITY TO CONNECT A CALL TO 911 OR ANY OTHER EMERGENCY SERVICE. VTEL WIRELESS OFFERS DATA-ONLY PLANS. WE DO NOT OFFER FIXED OR MOBILE TELEPHONE SERVICE.Unless prohibited by law, VTel isn’t liable for any indirect, special, punitive, incidental or consequential losses or damages you or any third party may suffer by use of, or inability to use, Services, Software, Devices or Equipment provided by or through VTel, including loss of business or goodwill, revenue or profits, or claims of personal injuries. Service may be interrupted, delayed, or otherwise limited for a variety of reasons, including environmental conditions, unavailability of radio frequency channels, system capacity, disaster or emergency communications, equipment modifications and repairs, and problems with the facilities of interconnecting carriers.The use of some Services, including certain Content, may require hardware, software, subscription, credit or debit card, Internet access from your compatible PC and/or special network connection and you are solely responsible for arranging for or obtaining all such requirements.Notwithstanding the foregoing, if your Service is interrupted for 24 or more continuous hours by a cause within our control, we will issue you, upon request, a credit equal to a pro-rata adjustment of the monthly Service fee for the time period your Service was unavailable, not to exceed the monthly Service fee. Our liability to you for Service failures is limited solely to the credit set forth above.To the full extent allowed by law, you hereby release, indemnify, and hold VTel Wireless and its officers, directors, employees and agents harmless from and against any and all claims of any person or entity for damages of any nature arising in any way from or relating to, directly or indirectly, service provided by VTel Wireless or any person’s use thereof (including, but not limited to, vehicular damage and personal injury), INCLUDING CLAIMS ARISING IN WHOLE OR IN PART FROM THE ALLEGED NEGLIGENCE OF VTEL WIRELESS, or any violation by you of this Agreement. This obligation shall survive termination of your Service with VTel Wireless. VTel Wireless is not liable to you for changes in operation, equipment, or technology that cause your Device or software to be rendered obsolete or require modification.Any information you involuntarily or voluntarily provide to third parties is governed by their policies or terms. The accuracy, appropriateness, content, completeness, timeliness, usefulness, security, safety, merchantability, fitness for a particular purpose, transmission or correct sequencing of any application, information or downloaded data is not guaranteed or warranted by VTel Wireless or any content providers or other third party. Delays or omissions may occur. Neither VTel Wireless nor its content providers, service providers or other third parties shall be liable to you for any loss or injury arising out of or caused, in whole or in part, by your use of any information, application or content, or any information, application, or other content acquired through the Service.
  3. ACCESS, PASSWORDS, AND SECURITY. You agree immediately to notify VTel Wireless at (802) 885-4444 or at info@vtelwireless.com if you become aware of any of the following:
    1. Any loss or theft of your user name(s) and or password(s).
    2. Any unauthorized use of any user name(s), password(s) or of the service.You will be responsible for the confidentiality and use of your user name(s) and password(s). You will be responsible for all activities entered through your user name(s) and password(s), and any requests so received by VTel Wireless will be deemed to have been received from you.
  4. SOFTWARE BROWSERS AND DATA TRANSMISSIONS. You acknowledge that the transmission of data on the Internet, including e-mail and personal financial data, is not secure and may be accessed by unauthorized third parties. You acknowledge that VTel Wireless is not responsible for notifying you of any upgrades, fixes or enhancements to any “browser” software or for any compromise of data transmitted across the Internet.
  5. SUBSCRIPTION, SERVICE, USE FEES. VTel Wireless’s offers for “unlimited Internet” and other “unlimited” services are all subject to the following limits: Because there will always be some customers who make use of “unlimited” Internet or other services in ways VTel Wireless considers unusual or excessive, VTel Wireless reserves the right to inform such users – at VTel Wireless’ sole discretion–they are operating outside acceptable levels, and to restrict or terminate service, or charge extra for future service. VTel Wireless’ caps for Internet usage exist, and will vary based on VTel Wireless’ determination of what is fair and reasonable; You agree to pay all subscription, service, and use fees, if any, which you are charged by VTel Wireless for the service and agree that such fees may be changed without notice. Free electronic monthly statements are delivered to your SmartHub portal account between the 28th to the 30th of each month; Paper statements are available at a charge upon Customer’s request. Individual paper statements will be charged $7.95; Recurring paper statement requests will be billed at $5.95 per month unless Customer requests a cancelation.  You agree to pay all costs (attorney’s fees), if any, incurred by VTel Wireless in collecting overdue fees from you. You also agree to pay all federal, state and local taxes applicable to your use or receipt of the service. Your account is activated upon receipt of your first payment for equipment (if purchasing directly from VTel Wireless), and/or verbal agreement to contracted service or upon receipt of a Confirmation Email from VTel Wireless, and will be active and billed until you contact us by phone during business hours (802-885-4444, Monday-Friday, 8am-6pm or Saturdays, 8am-5pm) to modify, suspend, or disconnect your service. You may request a call to any U.S. or Canadian phone number to disconnect your account, if you are unable to call our office directly by sending an email to info@vtelwireless.com, Written termination notice, or temporary account suspension, may be delivered by hand, by US Mail, by any courier service, to: VTel Wireless, 354 River Street, Springfield, VT 05156, by email at or via our online portal. Service costs will be calculated on the 23rd of the month, and invoiced on the 28th of the month, unless this day falls on a weekend or holiday, in which case, service(s) will be billed or invoiced on the following business day. Accounts will be temporarily suspended if payment is not received within 30 days of VTel sending an invoice. If your account is suspended, you will not be able to use VTel Wireless Services and if you reconnect service, you will be treated as a new customer and subject to new customer offers and/or fees. By reactivating as a new customer, previous promotions, data plans and/or rates will not be made available upon reconnection. As a new customer you will be subject to any applicable data plans at current rates and/or data thresholds. IF YOU DISPUTE ANY CHARGES ON YOUR BILL, YOU MUST NOTIFY US IN WRITING AT INFO@VTELWIRELESS.COM WITHIN 30 DAYS OF THE DATE OF THE BILL OR YOU’LL HAVE WAIVED YOUR RIGHT TO DISPUTE THE BILL AND TO PARTICIPATE IN ANY LEGAL ACTION RAISING SUCH DISPUTE. You agree that for each bill not paid in full by the due date, VTel may charge and you will pay a late payment fee of $5 each month. Service will be invoiced monthly and paid one month in advance. The initial month of service will be prorated and billed in the initial bill. Payment is due on the 23rd of every month. Accounts are in default if payment is not received by the 24th day of the month. If your account gets disconnected for late payment, there is a $45 reconnection fee. If you have more than one account with us, you must keep all accounts in good standing to maintain Services. If one account is past due or over its limit, all accounts in your name are subject to interruption or termination and all other available collection remedies. An account in default may be deleted. If your account is deleted, you will be treated as a new customer. By reactivating as a new customer, previous promotions, data plans and/or rates will not be made available upon reconnection. As a new customer you will be subject to any applicable data plans at current rates and/or data thresholds. You expressly authorize, and specifically consent to allowing, VTel Wireless and/or its outside collection agencies, outside counsel, or other agents to contact you in connection with any and all matters relating to unpaid past due charges billed by VTel Wireless to you, and such contact may include individual persons attempting to communicate with you, pre-recorded or artificial voice messages delivered by an automatic telephone dialing system, pre-set e-mail messages delivered by an automatic e-mailing system, or any other pre-set electronic messages delivered by any other automatic electronic messaging system. You agree that, for attempts to collect unpaid past due charges, such contact may be made to any mailing address, telephone number, cellular phone number, e-mail address, or any other electronic address that you have provided, or may in the future provide, to VTel Wireless.
  6. LOCKED or DELETED ACCOUNTS. If there is a restriction on your account(s), you will not be able to use the service until the account is unlocked. VTel Wireless reserves the right in its sole discretion to request a cash deposit to unlock the account. VTel Wireless will not be responsible for any delay or failure to provide the service in the event there is a lock placed on your account(s) or you delay or fail to make such deposit.
  7. INDEMNIFICATION. You agree to defend, indemnify and hold VTel Wireless from and against any and all claims, losses, liability costs and expenses (including but not limited attorneys’ fees) arising from your violation of this Agreement or any third-party’s rights, including but not limited to infringement of any copyright, violation of any proprietary right and invasion of any privacy rights. This obligation will survive the termination of this agreement.
  8. OUR ABILITY TO TERMINATE SERVICES. VTel Wireless reserves the right to terminate your access to the service or any portion of it in sole discretion, without notice and without limitation, for any reason whatever, including but not limited to the unauthorized use of your user name(s) and password(s), breach of this Agreement, and the discontinuance of VTel Wireless’ access to any Information or data from any Information Provider or termination of one or more agreements between VTel Wireless and Information Providers. In the event of a termination by VTel Wireless, VTel Wireless shall have no liability to you, provided, however, that if the termination is without cause VTel Wireless will refund the pro rated portion of any fee which may have been paid by you for the portion of the Service not furnished to you as for the date of such termination.
  9. INDIVIDUAL USE OF INFORMATION. As a condition of being approved to use our services, you represent and agree that the following statements are and will continue to be true for as long as you use our services. Your account can be used by you and your immediate family only. Resale of our services is prohibited. Our services provide one login account per customer which is to be used ONLY for customer/organization or immediate family. This account is non-transferable and should not be used by anyone other than the customer or immediate family. We prohibit any individual or business from using these facilities to resell voice, data, video, or other services without our express written permission and prices adapted accordingly. This applies to all access mediums, fiber, copper, and wireless; and whether the user is for or non-profit.
  10. E-MAIL AND WWW COMMUNICATIONS. The service provides you with the capability to send e-mail directly to the Internet. You agree to the following terms with respect to your use of e-mail through the service:
    1. You acknowledge that e-mail and other data transmitted on the Internet is not secure and may be accessed by unauthorized third parties. In no event will VTel Wireless be liable for any costs, damages, expenses or any other liabilities incurred by you or other parties as a result of any such unauthorized access by third parties;
    2. You will not use e-mail of the service for any purpose which is unlawful, abusive, harassing, libelous, defamatory, obscene, or threatening. You will not use the Service to solicit VTel Wireless customers or others or participate in the solicitation of VTel Wireless customers or others for any purpose.
    3. AT NO TIME WILL YOU SEND UNSOLICITED E-MAILS FROM YOUR ACCOUNT. E-MAIL THAT CREATES A COMPLAINT WILL BE CONSIDERED UNSOLICITED. “SPAM” VIOLATION WILL RESULT IN IMMEDIATE DELETION OF THE OFFENDING ACCOUNT.
    4. You will not upload, post, reproduce or distribute any information, software or other material protected by copyright or any other material protected by copyright or any other intellectual property right (as well as rights of publicity and privacy) without first obtaining permission of the holders of such rights; and
    5. You will not in any way express or imply that the opinions in your e-mail messages are endorsed by VTel Wireless without the prior written consent of VTel Wireless.
    6. You will not in any way express or imply that the opinions or contents of your web pages are endorsed by or in any way related to VTel Wireless without the prior written consent of VTel Wireless.
    7. VTel Wireless reserves the right to restrict or remove information on our server containing any subject considered in poor taste, offensive or containing sexually explicit or graphical content, or subjects related to activities that can threaten the security of our network.
  11. GENERAL. You acknowledge that, in providing you with Internet access, VTel Wireless has relied upon your agreement to be bound by the terms of this agreement. You further acknowledge that you have read, understood and agreed to be bound by the terms of this Service Agreement.
  12. ON-LINE SERVICES. This agreement may be modified at any time. Your use of the Service after receiving such notice will indicate your acceptance of the modification. If any provision of this Agreement is invalid or unenforceable under applicable law, it is, to that extent, deemed omitted and the remaining provisions will continue in full force and effect. This Agreement and performance hereunder will be governed by and construed in accordance with the laws of the state of Vermont, as applied to agreements entered into and completely performed in Vermont. VTel is not responsible for any charges incurred by you, the Internet customer, for telephone-related charges (including long distance calls) used while on-line with our Internet service or any other charges you might incur. You are subject to and responsible for any Local Measured Service charges as applied from your local telephone company. Phone calls to our technical support number, (802) 885-4444 may be long distance for you.
  13. WIRELESS MOBILE VOICE SERVICES.  In addition to the foregoing Terms of Service applicable to all VTel Wireless customers, all customers/users of VTel Wireless mobile voice services further agree to the following wireless mobile voice services Terms of Service.Please read this section of the Agreement carefully. This is a binding agreement between you and VTel Wireless. Your registration, payment for, or use of the wireless mobile voice services constitutes your agreement to be bound by the charges, terms, and conditions set forth in this Agreement, including those incorporated by reference into this Agreement.
    1.  (13.1.a) YOUR WIRELESS DEVICE.  Your wireless device must comply with Federal Communications Commission regulations and be compatible for use on VTel’s network. Please be aware that we may change your wireless device’s software, applications or programming remotely, without notice. This could affect your stored data, or how you’ve programmed or use your wireless device. By activating Service that uses a SIM (Subscriber Identity Module) card, you agree we own the intellectual property and software in the SIM card that we may change the software or other data in the SIM card remotely and without notice, and we may utilize any capacity in the SIM card for administrative, network, business and/or commercial purposes.
      1. (13.1.b) HEARING AID COMPATIBILITY of YOUR MOBILE WIRELESS DEVICEWhen mobile wireless devices are used near hearing aid devices, users may experience audible interference. Some hearing devices are more immune than others to this interference, and wireless devices also vary in the amount of interference they generate.FCC HAC ratings: The FCC defines Hearing Aid Compatiblity (HAC) for cell phones in terms of two parameters; radio-frequency (RF) emissions and telecoil coupling.M-Rating: The M-rating determines the Radio Frequency emissions level and signal quality of a phone. Phones with a higher M-rating have a lower RF emissions level and a higher signal quality.
        • The hearing aid must be in microphone mode in order to replicate the mode that was used to achieve the rating.
        • The phone’s M-rating, along with the hearing aids M-rating, assists customers in finding a phone that works best for them.
        • It is recommended that the rating of the 2 devices (hearing aid and phone) add up to at least a 5.

        T-Rating: A Telecoil is a small device built into some hearing aids that allow for a better experience when using a telephone or listening device. Not all hearing aids or listening devices have a Telecoil.

        • The Telecoil on a hearing aid is switched to the T position, or a button on the hearing aid is pushed to select the Telecoil setting.
        • The Telecoil gathers magnetic fields generated by telephones and converts these fields into sound.

        Telecoil is particularly useful for telephone communication because it permits the volume control of a hearing aid to be turned up without creating feedback or whistling. Background noise can be reduced, especially when using devices in noisy places.

    2. (13.2) WHERE AND HOW DOES VTEL WIRELESS MOBILE VOICE SERVICE WORK?  VTel Wireless mobile voice service is available in VTel’s Vermont coverage area. Wireless devices use radio transmissions, so unfortunately you can’t get service if your device isn’t in range of a transmission signal. Please be aware that even within our coverage area, many things can affect the availability and quality of your service, including network capacity, your device, terrain, buildings, in-vehicle use, foliage, weather, network availability and coverage levels, tasks, file characteristics, applications and other factors. VTel Wireless does not guarantee availability of the wireless network. Services may be subject to certain device and compatibility/limitations including memory, storage, network availability, coverage, accessibility and data conversion limitations. Services (including without limitation, eligibility requirements, plans, pricing, features and/or service areas) are subject to change without notice.When outside VTel’s coverage area, access will be limited to information and applications previously downloaded to or resident on your device. Coverage areas vary between VTel network technologies.
    3.  (13.3) HOW DOES VTEL WIRELESS CALCULATE VOICE MINUTES?  For outgoing calls, usage time starts when you first press Send or the call connects to a network, and for incoming calls, it starts when the call connects to a network (which may be before it rings). Usage time may end several seconds after you press End or after the call disconnects.
    4.  (13.4) WHAT IS ROAMING?  You’re “roaming” whenever your wireless device connects to a network outside VTel’s coverage area or connects to another carrier’s network, which could happen even within your coverage area. There may be higher rates or extra charges and your data service may be limited or slowed, when roaming. VTel does not currently offer roaming, and you will be notified before roaming is implemented for VTel mobile voice service.
    5. (13.5) AM I RESPONSIBLE IF SOMEONE MAKES A PURCHASE WITH MY DEVICE?  Except as otherwise provided in this Agreement, if your device is used by others to make content purchases, you are responsible for all such purchases. If this occurs, you are giving those other users your authority to:
      1. make content purchases from those devices, and to incur charges for those content purchases that will appear on your bill;
      2. give consent required for that content, including the consent to use that user’s location information to deliver customized information to that user’s device; or
      3. make any representation required for that content, including a representation of the user’s age, if requested.
    6. (13.6) DOES VTEL COLLECT LOCATION-BASED NETWORK PERFORMANCE INFORMATION FROM MY DEVICE?  VTel Wireless may collect information about the approximate location of your device in relation to our cell towers and the Global Positioning System (GPS). We use that information, as well as other usage and performance information also obtained from our network and your device, to provide you with wireless voice and data services, and to maintain and improve our network and the quality of your wireless experience. We may also use location information to create aggregate data from which your personally identifiable information has been removed or obscured. Such aggregate data may be used for a variety of purposes such as scientific and marketing research and services such as vehicle traffic volume monitoring. It is your responsibility to notify users on your account that we may collect and use location information from devices.
    7. (13.7) DISCLAIMER OF WARRANTIES  VTel Wireless makes no representations or warranties, express or implied, including, to the extent permitted by applicable law, any implied warranty of merchantability or fitness for a particular purpose, about your mobile voice service, your wireless device, or any applications you access through your wireless device. We do not warrant that your wireless device will work perfectly or will not need occasional upgrades or modifications, or that it will not be negatively affected by network–related modifications, upgrades or similar activity. If you download or use applications, services or software provided by third parties (including voice applications), 911 or E911, or other calling functionality, may work differently than services offered by us, or may not work at all. Please review all terms and conditions of such third–party products. VTel Wireless is not responsible for any third–party information, content, applications or services you access, download or use on your device. You are responsible for maintaining virus and other Internet security protections when accessing these third–party products or services. VTel Wireless is not a publisher of third-party information, applications, or other content and is not responsible for any opinions, advice, statements, or other information, services or goods provided by third parties.Third-party content or service providers may impose additional charges. Policies regarding intellectual property, privacy and other policies or terms of use may differ among VTel’s content or service providers and you are bound by such policies or terms when you visit their respective sites or use their services. It is your responsibility to read the rules or service agreements of each content provider or service provider.Any information you involuntarily or voluntarily provide to third parties is governed by their policies or terms. The accuracy, appropriateness, content, completeness, timeliness, usefulness, security, safety, merchantability, fitness for a particular purpose, transmission or correct sequencing of any application, information or downloaded data is not guaranteed or warranted by VTel or any content providers or other third party. Delays or omissions may occur. Neither VTel nor its content providers, service providers or other third parties shall be liable to you for any loss or injury arising out of or caused, in whole or in part, by your use of any information, application or content, or any information, application, or other content acquired through the mobile voice service.You acknowledge that every business or personal decision, to some degree or another, represents an assumption of risk, and that neither VTel nor its content and service providers or suppliers, in providing information, applications or other content or services, or access to information, applications, or other content underwrites, can underwrite, or assumes your risk in any manner whatsoever.
    8. (13.8) WAIVERS AND LIMITATIONS OF LIABILITY  You agree VTel Wireless is not responsible for problems caused by you or others, or by any act of God. You also agree we aren’t liable for missed or deleted voice mails or other messages, or for any information (like pictures) that gets lost or deleted if we work on your device. If another wireless carrier is involved in any problem, you also agree to any limitations of liability that it imposes. WE DO NOT GUARANTEE YOU UNINTERRUPTED SERVICE OR COVERAGE. WE CANNOT ASSURE YOU THAT IF YOU PLACE A 911 CALL YOU WILL BE FOUND. VTEL MAKES NO WARRANTY, EXPRESS OR IMPLIED, OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, SUITABILITY, ACCURACY, SECURITY, OR PERFORMANCE REGARDING ANY SERVICES, SOFTWARE OR GOODS, AND IN NO EVENT SHALL VTEL BE LIABLE, WHETHER OR NOT DUE TO ITS OWN NEGLIGENCE, for any:
      1. act or omission of a third party;
      2. mistakes, omissions, interruptions, errors, failures to transmit, delays, or defects in the services or software provided by or through us;
      3. damage or injury caused by the use of services, software, or device, including use in a vehicle;
      4. claims against you by third parties;
      5. damage or injury caused by a suspension or termination of services or software by VTel; or
      6. damage or injury caused by failure or delay in connecting a call to 911 or any other emergency service.If we don’t enforce our rights under this agreement in one instance, that doesn’t mean we won’t or can’t enforce those rights in any other instance. You cannot assign this Agreement or any of your rights or duties under it without our permission.

(13.9) USING 9-1-1 ON YOUR VTEL WIRELESS MOBILE DEVICE  The U.S. federal government has designated 9-1-1 as the national uniform code for reaching emergency services (e.g., police, fire, emergency medical). VTel Wireless works with public safety agencies to provide reliable 9-1-1 service for our customers. We provide enhanced location information to emergency call takers so they can more effectively route calls for emergency assistance. The Enhanced 911 service—also known as E911—that we provide to public safety answering points does two things. First, it automatically delivers the 911 caller’s telephone number to the call-taker. Second, it enables the call-taker to obtain information to determine the estimated location of the caller within certain geographic parameters and then to dispatch emergency responders who are within or close to those parameters.E911 is provided for all GPS-capable phones where Public Safety Answering Points (PSAPs) have Enhanced-911 capable equipment or systems. Because wireless phones can react to the environment—from weather conditions to surrounding terrain—the enhanced location information we provide to emergency call takers can’t guarantee a precise location. In some places, public safety call takers still rely only on the caller’s descriptions to locate and dispatch help to people in emergency situations. WE DO NOT GUARANTEE YOU UNINTERRUPTED SERVICE OR COVERAGE. WE CANNOT ASSURE YOU THAT IF YOU PLACE A 911 CALL YOU WILL BE FOUND. VTEL MAKES NO WARRANTY, EXPRESS OR IMPLIED, OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, SUITABILITY, ACCURACY, SECURITY, OR PERFORMANCE REGARDING ANY SERVICES, SOFTWARE OR GOODS, INCLUDING 911 SERVICES, AND IN NO EVENT SHALL VTEL BE LIABLE, WHETHER OR NOT DUE TO ITS OWN NEGLIGENCE, FOR ANY DAMAGE OR INJURY CAUSED BY FAILURE OR DELAY IN CONNECTING A CALL TO 911 OR ANY OTHER EMERGENCY SERVICE.Be aware that some third party applications available via your smartphone, and devices other than wireless phones that you may use with our network (such as tablets and laptops), may enable you to use other companies’ applications and services to make voice calls.  VTel Wireless does not provide E911 for these calls and you should always read the terms and conditions of service for these products to learn whether you can reach 911 when using them.  If you download or use applications, services or software provided by third parties (including voice applications), 911 or E911, or other calling functionality, may work differently than services offered by us, or may not work at all.VTel Wireless does not currently offer text service on its network, therefore text-to-911 is not available until text messaging service is available on the VTel network.VTel Wireless offers the following tips when making an emergency call:
      • Make sure it’s an emergency. But if you feel life or property is immediate danger and you need help from a public safety agency, don’t hesitate. This wastes time, and delays an emergency response.
      • “Tell the operator as much information about the location of the emergency as possible and what assistance is needed”. Stay on the phone and answer all questions until the operator tells you to hang up. You may be asked for your mobile number in case the emergency operator needs to call you back. (Even though emergency operators may have your number and location information, they will usually try to verify it.)
      • Most public safety agencies have a regular, seven-digit telephone number for non-emergency calls. It’s a good idea to identify the numbers for the agencies in the areas where you normally travel, and program them into your VTel Wireless device. Use these numbers when you need assistance, but the matter is less urgent.
      • DO NOT program 9-1-1 into your phone. It can lead to accidental calls to 9-1-1 and tie up emergency operators. 9-1-1 is the phone number you won’t ever forget, so it doesn’t need to be in the phone’s memory.Emergency calls are answered by employees of your local or state government. If you would like more information about emergency calling in your area, you should contact your state or local government and ask about your 9-1-1 service.
    10. PROHIBITED VOICE ROBOCALLING/SPOOFING: It is prohibited to create, facilitate or otherwise use the VTel or VTel Wireless network to generate robocalls or call spoofing. In order to help reduce the number of illegal robocalls that may originate on our network, effective July 1, 2021, VTel & VTel Wireless have implemented robocall mitigation efforts to monitor our network and verify that calls originating over our network are legitimate numbers belonging to a valid VTel or VTel Wireless customer. In line with FCC rules, users of VTel or VTel Wireless’ voice services are prohibited from originating illegal or spoofed robocalls with the intent to defraud, cause harm or wrongly obtain anything of value from the recipient of the call.
